NOTE: Although vote swapping has been established by a Federal Appeals Court to be a legal right, protected by the First Amendment, Colorado still has a law on its books which says it is “unlawful for any person to facilitate the trading of votes between an elector in the state or a person in another state in exchange for the other person’s vote for or against a particular candidate…” Vote swapping is therefore not recommended in Colorado except through personal contacts.

In 2024, the Republican, Jeff Crank, won this seat with a margin of 13.8 percent, or 49,952 votes, over the Democrat, River Gassen. An estimated 175,815 eligible voters (32.7%) did not vote at that election in Colorado District 5, and 16,189 voted for a third (or fourth) party.
